*Construction sites in Ontario are governed by two overlapping laws: Ontario Regulation 1101 under the Workplace Safety and Insurance Act (WSIA), which sets first aid kit contents and training requirements; and O. Reg. 213/91 under the Occupational Health and Safety Act (OHSA), which adds construction-specific requirements enforced by the Ministry of Labour, Immigration, Training and Skills Development (MLITSD). Quarterly inspections are the minimum; monthly is strongly recommended on active sites.
⚡ NEW as of January 1, 2026 — AED Requirement: Under O. Reg. 157/25 (amending O. Reg. 213/91), constructors must install and maintain a Health Canada–licensed AED on any project where 20 or more workers are regularly employed and work is expected to last three months or more. Understanding Ontario Construction Site First Aid Requirements

Ontario construction sites are subject to a dual regulatory framework. First aid kit contents, training levels, and inspection records are governed by Ontario Regulation 1101 under the Workplace Safety and Insurance Act (WSIA), administered by the WSIB. Construction-specific requirements — including emergency procedure postings, Notice of Project obligations, and (as of January 1, 2026) AED requirements — are governed by O. Reg. 213/91 (Construction Projects) under the Occupational Health and Safety Act (OHSA), enforced by Ministry of Labour, Immigration, Training and Skills Development (MLITSD) inspectors.

Kit size under Reg. 1101 is determined by the number of workers on site at any one time: 1–5 workers requires a Section 8 kit with an Emergency First Aid–trained worker; 6–15 workers requires a Section 9 kit plus a stretcher and two blankets, with a Standard First Aid–trained worker; 16–199 workers requires a Section 10 kit, stretcher, and blankets, with a Standard First Aid–trained worker. Projects with 200 or more workers require a dedicated first aid room. Inspection cards must be signed quarterly at minimum, with monthly inspections strongly recommended on active sites.

Construction sites present hazards distinct from other workplaces — falls from heights, struck-by incidents, crush injuries, power tool lacerations, welding and hot tar burns, and eye injuries from grinding, concrete dust, and chemical exposure. This makes construction-specific stocking (eyewash, burn dressings, splints, heavy trauma dressings) essential beyond the Reg. 1101 minimums. The new AED requirement (O. Reg. 157/25), in force January 1, 2026, adds a mandatory defibrillator to any project where 20+ workers are regularly employed and the project is expected to run three months or more.
